This webinar will explore why it still is important for employers to perform data analyses of their employment decisions and compensation practices. Although there no longer is an explicit requirement to prepare race, sex, and ethnicity-based analyses as part of a federal affirmative action plan, there remain compelling reasons why employers should continue to run these analyses.

In this webinar, the attorneys from Roffman Horvitz will provide an overview of federal and state nondiscrimination laws and the mechanics for enforcing False Claims Act violations under Executive Order 14173 (“Ending Illegal Discrimination and Restoring Merit-Based Opportunity”) to underscore the importance of proactive analysis of employment decisions. They also will discuss the significance of attorney-client privilege and best practices for establishing it.

What to Expect

This presentation will cover:

  • Analytics you need in 2026 to support hiring and employment decisions
  • Value of collecting gender and race/ethnicity data
  • Impact of abandoning lawful inclusion initiatives
  • Risks associated with not doing analytics, including the False Claims Act
  • Best practices to keep analytics focused, consistent and action-oriented
  • Establishing appropriate guardrails when conducting analyses

You’ll get a prioritized view of which analytics will help to detect patterns that you should be addressing proactively before they surface in a complaint or investigation.
