On March 26, 2026, President Trump issued Executive Order 14398 ("Addressing DEI Discrimination by Federal Contractors"). The new Executive Order supplements previous executive orders and other Trump Administration enforcement initiatives by adding a six-paragraph clause to all federal contracts. The new Executive Order addresses disparate treatment based on race or ethnicity in "recruitment, employment, contracting, program participation, or allocation or deployment of an entity's resources." The Executive Order introduces a new enforcement regime, with every new contract being the basis for a potential DEI audit conducted by the contracting agency itself. Prime contractors also are required to report knowable subcontractor noncompliance. The new Executive Order authorizes contracting agencies to cancel the contract and make the contractor ineligible for future contracts. In short, the EO introduces a much more aggressive enforcement regime to the Administration's anti-DEI efforts.

Joshua S. Roffman is the Managing Attorney and co-founder of Roffman Horvitz, PLC. The Firm advises employers on a broad array of human resource compliance matters. Josh has been advising employers for more than 20 years. He has deep experience in advising clients regarding pay equity, inclusion and diversity programs, federal contractor employment regulations, and analysis of employment data. In assisting employers over the course of his career, he has developed a thorough understanding of the gamut of human resources issues and how they affect businesses and organizations. Josh combines his understanding of employment law, statistics, and how businesses and organizations operate to develop regressions and other statistical analyses of various employment practices, including compensation, that are tailored to the specific goals and circumstances of the individual client. Josh works closely with his clients to assess how best to run the analyses, which he and the Firm run in-house.

James M. McCauley, Of Counsel - Roffman Horvitz, PLC
James McCauley is an Associate Attorney with Roffman Horvitz. His primary focus is assisting in the preparation of affirmative action plans for federal government contractors. James's experience includes creation and review of affirmative action plans, preparation of EEO-1 employment data, and analysis of applicant and hire records to address potential claims of hiring disparities. Prior to working at Roffman Horvitz, James held legal internships at the Department of Justice Immigrant and Employee Rights section (IER), and the Equal Employment Opportunity Commission's Washington Field Office. He also received the International Academy of Trial Lawyers Student Advocacy Award for his work in the Georgetown Law Civil Rights Clinic.
